WikiChess — Terms of Service

1. Acceptance
By downloading, installing, or using the WikiChess mobile application (“App”) you agree to be bound by these Terms (“Terms”). These Terms form a legally binding agreement between you and Cankat Saraç.
2. Description of service
WikiChess is a single-player puzzle game in which the player navigates Wikipedia by clicking inline article links to reach a target article in as few hops as possible. The App displays Wikipedia content under Wikipedia’s content license (see Section 6.2).
3. Eligibility
You must be at least 13 years old to use WikiChess, or 16 in the European Economic Area unless you have verifiable parental or guardian consent.
4. Acceptable use
- Do not use the App in violation of any law or regulation.
- Do not reverse-engineer, decompile, or disassemble the App.
- Do not use the App to scrape, mirror, or systematically extract Wikipedia content in violation of Wikimedia’s terms of service or robot policies.
- Do not send abusive volumes of requests to Wikipedia through the App.
- Do not use the App to harass, defame, or harm any individual.
5. No subscription (current version)
WikiChess is offered free of charge in this version. We reserve the right to introduce paid plans in future releases.
6. Intellectual property
6.1 Our IP
The App is the intellectual property of Cankat Saraç, protected by copyright, trademark, and applicable IP law.
6.2 Wikipedia content
Article content displayed in the App is sourced from Wikipedia, licensed primarily under the Creative Commons Attribution-ShareAlike 4.0 (CC BY-SA 4.0) license. The App attributes each article to Wikipedia and links back to the source. We claim no ownership over Wikipedia content.
6.3 License to use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device for personal, non-commercial purposes.
7. Third-party content
Wikipedia articles may contain text, images, opinions, statements of fact (which may later prove incorrect), discussions of historical events, or descriptions of sensitive subjects. We do not endorse, verify, or warrant any Wikipedia content shown in the App. You access Wikipedia content at your own risk.
8. Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that Wikipedia content is accurate, current, or appropriate for any purpose, that the App will be uninterrupted or error-free, or that any particular article will be available at any time.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CANKAT SARAÇ, HIS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED USD $10, OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. Nothing here limits liability that cannot lawfully be limited.
10. Indemnification
You agree to indemnify, defend, and hold harmless Cankat Saraç and his affiliates from any claims, damages, costs, and expenses arising out of your use of the App in violation of these Terms or applicable law.
11. Third-party services
The App relies on the Wikimedia Foundation’s public APIs. Wikimedia is governed by its own terms of use and privacy policy. We are not responsible for Wikimedia services. We make no warranty about Wikipedia’s availability.
12. Modifications and termination
We may modify, suspend, or discontinue the App at any time. Material changes are communicated via in-app notice on the next launch. You may terminate by uninstalling the App.
13. Governing law and disputes
13.1 Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws principles.
13.2 Informal resolution
Contact cankatsarac@gmail.com for at least 30 days before any formal claim.
13.3 Arbitration (non-EU / non-UK)
Disputes shall be submitted to binding individual arbitration under the Rules of the Istanbul Arbitration Centre (ISTAC), seated in Istanbul, Türkiye, in English. You waive class-action rights. If the class waiver is unenforceable, the remainder continues.
13.4 EU / EEA users
You may bring proceedings in the courts of your country of residence.
13.5 UK users
You may bring proceedings in the courts of England and Wales, Scotland, or Northern Ireland as applicable.
14. General
Entire agreement. These Terms and the Privacy Policy.
Severability. Unenforceable parts severed.
Waiver. Failure to enforce is not waiver.
Assignment. You may not assign; we may assign to a successor.
14.1 Apple-specific terms
If you obtained the App via the Apple App Store: these Terms are between you and Cankat Saraç only, not Apple; Apple is not responsible; Apple has no maintenance/support obligation; on warranty failure Apple may refund the purchase price (if any) but has no further obligation; we (not Apple) handle product-liability, conformity, and consumer-protection claims; we (not Apple) handle third-party IP claims; you represent you are not in a US-embargoed country and not on any US prohibited-parties list; Apple and its subsidiaries are third-party beneficiaries.
